Brightline is facing a wrongful death lawsuit filed by the family of a man who was struck and killed by a train in Boca Raton.
74-year old Jim Ostrowski, a retired Sara Lee and Hanes Underwear CEO, was crossing a designated "quiet zone" near Southwest 18th Street and South Dixie Highway back in October of 2022 when he was killed.
His wife's attorney blames "inadequate safety measures, including a faded "No Train Horn" sign and poor visibility due to bushes in the area.
The suit seeks a jury trial and judgement for damages. It also urges federal and local authorities to impose stringent safety measures.
Brightline trains can run as fast as 125 miles per hour, but maxes out at 79 miles per hour in populated areas.
The rail line won't comment on ongoing litigation.
